Facebook is a traffic source TRIVAGO is active in and TRIVAGO handles campaigns in relation to Facebook itself. d. acquire any Google Mail Special Promotions (GSP) traffic in the name of TRIVAGO. Google Mail Special Promotion Campaigns are handled by TRIVAGO itself, therefore the PUBLISHER is not allowed to advertise via GSP in the name of TRIVAGO and under the AGREEMENT. e. start any campaigns in the Yahoo Display Network. TRIVAGO handles such campaigns itself. f. acquire any incentivized traffic under the AGREEMENT, which includes without limitation cashback and coupon sites. In particular it is prohibited to advertise a cashback for doing a clickout on trivago as well as incentivize traffic by promising a free live in a game, points, cash or any rewards in other forms for doing a clickout on trivago. Furthermore, it is not allowed to advertise trivago on a coupon website, where a voucher is offered if the user clicks on trivago’s advertisement (“click2trick”). g. acquire any AdWare traffic under the AGREEMENT. This means in particular but shall not be limited to overriding links or integrating a trivago search bar into an adbar. 1.2 For each event of an infringement of the obligations listed above committed by the PUBLISHER, KWANKO is entitled to claim liquidated damages in the amount appropriate for the damages regardless of completion of the payment for the fraudulent traffic up to 6 months before the notification by E-mail. 2. Fraudulent Activities 2.1. The PUBLISHER must not engage in any fraudulent activities in order to fulfill its obligations under this agreement. Fraudulent activities include in particular but without limitation bots, automated lead generation, wrong linking, direct linking to lead page and multiple leads. 2.2. If during a campaign KWANKO discovers such fraudulent activities committed by the PUBLISHER, KWANKO is entitled to stop the campaign immediately without complying with any notice period and is not obliged to pay and cannot be held liable for any performance that was obtained under the influence of such fraudulent activities. 3. To-be-approved Activities 3.1. Any advertising for TRIVAGO on Real Time Bidding is strictly prohibited for the PUBLISHER in relation to this agreement unless KWANKO has approved of it in writing (e-mail shall suffice). In case of an approval the PUBLISHER has to name the supply-side platform (SSP) which is to be used to TRIVAGO prior to the start of a Real Time Bidding campaign. 3.2. Any remarketing traffic under the name of TRIVAGO is prohibited for the PUBLISHER, unless TRIVAGO has explicitly stated otherwise in writing (e-mail shall suffice). 3.3. Any e-mail traffic under TRIVAGO’s name is strictly prohibited, unless KWANKO has explicitly stated otherwise in writing. The PUBLISHER may only receive the permission to engage in e-mail traffic if it has provided TRIVAGO with the Opt-In Rights for the database from which the PUBLISHER wants to sends the e-mails out in advance and informed TRIVAGO about the source of the database that is to be used. 3.4. The PUBLISHER is not allowed to use creatives (IAB Standard and customized Image Creatives, Image/Text Combinations/Text Ads) which are not provided by KWANKO. 3.1. Any advertising for TRIVAGO on Real Time Bidding is strictly prohibited for the PUBLISHER in relation to this agreement unless KWANKO has approved of it in writing (e-mail shall suffice). In case of an approval the PUBLISHER has to name the supply-side platform (SSP) which is to be used to TRIVAGO prior to the start of a Real Time Bidding campaign.

3.2. Any remarketing traffic under the name of TRIVAGO is prohibited for the PUBLISHER, unless TRIVAGO has explicitly stated otherwise in writing (e-mail shall suffice).

3.3. Any e-mail traffic under TRIVAGO’s name is strictly prohibited, unless KWANKO has explicitly stated otherwise in writing. The PUBLISHER may only receive the permission to engage in e-mail traffic if it has provided TRIVAGO with the Opt-In Rights for the database from which the PUBLISHER wants to sends the e-mails out in advance and informed TRIVAGO about the source of the database that is to be used.

3.4. The PUBLISHER is not allowed to use creatives (IAB Standard and customized Image Creatives, Image/Text Combinations/Text Ads) which are not provided by KWANKO. Any creatives which have been built by the PUBLISHER have to be approved by KWANKO via email before made use of.
